NHS England Urged to Introduce Independent Reviews for Staff Dismissals

NHS England is facing calls to implement an independent second opinion process for dismissals of healthcare professionals. This push follows the tragic case of nurse Amin Abdullah, who took his own life in 2016 after what has been described as an unfair dismissal. The proposal, referred to as “Amin’s Rule,” comes from Dr. Narinder Kapur, a consultant neuropsychologist and whistleblower.

Dr. Kapur has a personal history with the NHS; he was dismissed from Addenbrooke’s Hospital in Cambridge in 2010 after raising concerns regarding staff shortages and unqualified personnel working without appropriate supervision. An employment tribunal later determined that he had been unfairly dismissed, a case which cost him £300,000 funded through the sale of his home and his NHS pension.

In recent discussions with senior NHS officials, including NHS England Chief Executive Jim Mackey, Dr. Kapur emphasized the necessity of having a second external opinion in dismissal cases. He stated, “If they had a second external opinion when Abdullah had his kangaroo court or when I had my kangaroo court, that external person would almost certainly not have approved his unfair dismissal or my unfair dismissal.”

Dr. Kapur also highlighted the broader implications of staff wellbeing on patient care. He noted that healthcare professionals who blow the whistle often face retaliation, particularly those from minority backgrounds. Statistics reflect this concern; individuals of colour in the NHS are more likely to encounter disciplinary actions compared to their white counterparts. Additionally, minority ethnic doctors may hesitate to voice patient safety concerns due to fears of negative repercussions.

Abdullah’s case involved his suspension from Charing Cross Hospital after he signed a petition supporting a colleague, following a patient complaint. An independent inquiry, which Dr. Kapur helped initiate, concluded in 2018 that Abdullah had been “treated unfairly” by the Imperial College Healthcare NHS Trust. While the inquiry found that Abdullah should have realized the inappropriateness of signing the petition, it also noted that none of the other 18 signatories faced disciplinary action.

In addition to advocating for “Amin’s Rule,” Dr. Kapur is lobbying for broader protections for NHS staff. He proposes extending the Maintaining High Professional Standards framework, designed for doctors and dentists, to encompass all healthcare professionals. He also calls for a restructuring of the Care Quality Commission, suggesting it should be divided into two separate entities—one focused on patient care and the other on staff issues.

Dr. Kapur further criticized the NHS’s use of the “some other substantial reason” (SOSR) legal mechanism, which allows organizations to terminate employees for reasons beyond conduct or capability. Between April 2010 and September 2018, the NHS dismissed 10,604 employees under this clause, often citing a breakdown in relationships.

“If I can do things to make sure that what happened to me and Abdullah won’t happen to people in the future, I will do until there are meaningful improvements,” Dr. Kapur stated.

In response to these concerns, a spokesperson for NHS England announced that they are collaborating with the Department of Health and Social Care to enhance protections for whistleblowers. The spokesperson emphasized, “It is completely unacceptable for any member of staff to feel silenced or unable to speak up about issues affecting them or their patients.” They encouraged staff with concerns to reach out to their organization’s Freedom to Speak Up guardian to ensure the NHS learns from past mistakes and continues to provide high-quality care.
