Judge Questions DOJ Readiness in Letitia James Arraignment
UPDATE: In a stunning display of courtroom tension, U.S. District Judge Jamar Walker pressed federal prosecutors on their lack of preparation during the arraignment of New York Attorney General Letitia James on Friday, October 27, 2023, in Norfolk, Virginia. The judge’s inquiries raised significant concerns about the prosecution’s readiness as they struggle to sort through evidence in this high-profile federal case.
During the arraignment, Assistant U.S. Attorney Roger Keller Jr. revealed, “I am going through the discovery right now,” indicating that the prosecution is still piecing together their case. James, who pleaded not guilty, faced a courtroom eager for clarity and swift action from the government.
Judge Walker sharply rejected Keller’s request for an extension until mid-November to finalize evidentiary disclosures. “Waiting nearly a month after an indictment is not consistent with how we operate here,” he stated, emphasizing the urgency of a timely trial.
Keller’s proposal for a two-week trial, estimating eight to ten witnesses, was met with skepticism from James’ defense attorney, Abbe Lowell, who expressed doubt over the prosecution’s witness count. The courtroom atmosphere turned tense when Judge Walker asked Keller whether the pretrial services report had been received. Keller faltered, consulting with a colleague before admitting, “We have not, your honor… Oh, we have?”
“Do you need a moment?” Walker responded, highlighting the apparent disarray within the prosecution team. This hearing, lasting under an hour, showcased the DOJ’s struggle to assemble its case against James effectively, drawing comparisons to the recent prosecution of former FBI Director James Comey, where similar issues of disorganization were noted.
Following the arraignment, James addressed a supportive crowd, accusing the justice system of being weaponized as “a tool of revenge.” This statement underscores the emotional impact of the proceedings, not just on James, but on her supporters who rally behind her amidst the unfolding legal battles.
As the situation develops, observers are left questioning the efficacy and preparedness of the DOJ in this high-stakes case. With the prosecution scrambling for evidence and the defense poised for a vigorous fight, the upcoming weeks are set to be critical. Watch for further updates as both sides prepare for what promises to be a contentious legal battle.
