Trump’s Prosecutor Faces Urgent Threat After Major Legal Blunders
UPDATE: Major legal blunders by President Donald Trump’s appointed prosecutor, Lindsey Halligan, are threatening the integrity of the case against former FBI Director James Comey. In a scathing analysis published in The New York Times on October 26, 2023, legal expert David French asserts that Halligan’s recent errors could lead to the case being dismissed altogether.
The situation has escalated following revelations that Halligan failed to properly present the second indictment to the grand jury, a critical oversight that may have dire consequences. During grand jury proceedings, Halligan’s responses to juror inquiries were criticized as misleading, which French termed a “fundamental and highly prejudicial misstatement of the law.” Halligan’s apparent missteps have led to a climate of confusion and uncertainty regarding the future of the case.
As of now, the magistrate judge has not moved to dismiss the case, but French warns that Halligan’s procedural errors could have lasting implications. “We do not yet know if Halligan’s procedural irregularities will be fatal to the case, but if I’d committed that level of malpractice, it would have been instantly fatal to my continued employment,” he concluded.
